Josh Krusell


Biography
Josh Krusell is a partner with Stewart McDannold Stuart and is a member of our litigation group. Josh has conducted trials, appeals and judicial reviews at all levels of courts in B.C., and has appeared before administrative tribunals and private arbitrators in a broad range of disputes, including with respect to municipal, contractual, land use, tort, insurance and construction issues. He also provides strategic advice to clients with respect to tendering, procurement and regulatory and internal investigations.
Josh was called to the Ontario bar in 2012 and practised as a civil litigator with a leading national business law firm in Toronto prior to transferring to the British Columbia bar in 2018 to serve and represent local governments in B.C.
Josh is the past Chair of the Municipal Law Section of the Canadian Bar Association (B.C. Branch). He earned his Master of Public Administration and Juris Doctor degrees in 2011 from the University of Victoria and, prior to practising as a lawyer, Josh held positions within the B.C. public service.

- Andre and Karen Audet v. Assistant Water Manager, 2023 BCEAB 15 – Dismissal of an appeal before the Environmental Appeal Board seeking to overturn an order to decommission a dam.
- Bartlett v. Capital Regional District, 2024 BCSC 2564 – Successful defence to a challenge of an Alternative Approval Process for borrowing substantial funds for public housing projects.
- Braefoot Community Association v. Saanich (District), 2021 BCSC 2241 – Dismissal of a claim seeking to block the District’s attempt to end a community association’s tenancy and operation of a community recreation building.
- Chase Discount Auto Sales Ltd. v. Waugh and Village of Chase, 2019 BCCA 271 aff’g 2018 BCSC 2014 – Successful defence to a petition, and subsequent appeal, of the Village’s property maintenance bylaw.
- Clark v. Canada (Attorney General), 2024 FC 395 – Successful defence to a challenge of a public consultation process in relation to approval of a cellular tower.
- Columbia Shuswap (Regional District) v. Jones, 2018 BCSC 1776 – Successful injunction applications against property owners contravening a zoning bylaw and raising lawful non-conforming use defences.
- Kovacs v. City of Maple Ridge (No. 2), 2023 BCHRT 158 – Defending and reducing numerous complaints about insufficient accommodations for the visually impaired at multiple intersections.
- Lee v. Ontario Lottery and Gaming Corporation, 2017 ONSC 3745 – Dismissal of a challenge to an employer’s decision to terminate an employee.
- Maple Ridge (City) v. Copperthwaite, 2019 BCCA 99 – Successful appeal defence upholding an interim injunction authorizing the City to enter a homeless encampment and bring the lands into compliance with fire safety orders.
- Regional District of Nanaimo v. Fyfe, BCSC Court file no. NAN-S77932, October 2021 – Successful trial obtaining injunctions against property owner constructing without building permits along with an order for legal costs and disbursements.
- Sharma v. Saanich (District), 2022 BCPC 257 – Dismissal of a recount challenge to a municipal election.
