Katherine Reilly
Biography
Katherine (Kat) Reilly was called to the BC bar in 2007 and is widely regarded as an effective advocate, communicator, and negotiator. Katherine spent the first fifteen years of her career working in Vancouver as a litigator with a national business law firm. There, she primarily conducted complex corporate-commercial disputes, including high-stakes contract, tort, and construction matters. More recently, she worked as senior counsel with the BC Ministry of Attorney General where she represented the Province in high-profile and precedent-setting litigation including numerous injunction-related matters.
Katherine has extensive experience advising clients on urgent, sensitive matters and is adept at crisis management and strategic communications. Katherine is known for her practical, no-nonsense approach to files, and is dedicated to achieving results for her clients.
Representative Work
- Provided advice to senior Provincial government officials and members of Cabinet on matters related to housing, injunctions, confidential investigations, high-profile litigation files, and other strategic and sensitive matters.
- Abbotsford (City) v. Matsqui-Abbotsford Impact Society, 2025 BCCA 41; 2025 BCCA 78 – Acted for the Province in appeal proceedings and related BCSC proceeding concerning homeless encampment on municipal lands.
- Matsqui-Abbotsford Impact Society v. Canada (Attorney General), 2024 FC 1301 – Successfully applied to Federal Court on behalf of the Province to be added as a Respondent to high-profile judicial review regarding public use of illegal substances.
- British Columbia (Attorney General) v. Harm Reduction Nurses Association, 2024 BCCA 87, and related BCSC proceedings – Acted for the Province in challenge to legislation relating to public consumption of illegal substances. Successfully obtained stay of proceedings in BCSC proceeding (unreported decision).
- Kitsilano Coalition for Children & Family Safety Society v. British Columbia (Attorney General), 2024 BCCA 423; 2023 BCSC 1999 – Acted for the Province in summary trial and appeal defending constitutionality of supportive housing related legislation.
- Vandenberg v. Vancouver (City) Fire and Rescue Services, 2023 BCSC 2104 – Acted for the Province in judicial review regarding Vancouver Fire Chief’s order to clear homeless encampment.
- R. v. Koopman, R. v. Butler (2024 BCPC 210, 2023 BCPC 74, and related unreported decisions) – Successfully defended application to subpoena Dr. Bonnie Henry, and acted on behalf of the Province and Provincial Health Officer in criminal violation ticket proceedings related to Public Health Orders made during COVID-19 pandemic.
- 992704 Ontario Limited v. British Columbia (Attorney General), 2023 BCCA 346; 2021 BCCA 469 – Successful appeal and successfully defended application to strike in relation to appeal from judicial review of a decision of the Property Assessment Review Panel.
- Beaudoin v. British Columbia (Attorney General), 2022 BCCA 427 – Successful dismissal of appeal against Province and Provincial Health Officer, Dr. Bonnie Henry, in a judicial review and constitutional challenge of Gathering and Events Orders made during COVID-19 pandemic.
- Pal Lumber Co. (2007) Ltd. v. British Columbia (Forests, Lands, Natural Resource Operations and Rural Development), 2022 BCSC 734 – Dismissal of judicial review against Province relating to decisions of Timber Sales Manager.
- Teal Cedar Products Ltd. v. Rainforest Flying Squad, 2022 BCCA 26; 2022 BCSC 1661; 2021 BCCA 387; 2021 BCSC 1903; 2021 BCSC 1554; 2021 BCSC 1380 – Acted for Province in BCCA and BCSC proceedings relating to injunctions enjoining illegal blockades at Fairy Creek.
- Arbitration counsel in a confidential construction arbitration dispute involving over 20 distinct claims and over $300 Million (2017-2018)
- Iberdrola Energy Projects Canada Corporation v. Factory Sales & Engineering Inc., 2018 BCCA 272; 2017 BCSC 1776 – Acted for owner of biomass plant construction projects in lien and holdback related proceedings.
- United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union v. British Columbia (Chief Inspector of Mines), 2014 BCSC 1403 – Successfully defended petition for judicial review on behalf of corporate respondent in relation to a union’s challenge to set aside decisions of the Chief Inspector of Mines for B.C.
- Ross v. British Columbia Lottery Corporation, 2014 BCSC 320 – Successfully defended gaming company in trial seeking to establish a novel duty of care owed by casinos and lottery corporations towards problem gamblers.
- Luu v. Wang, 2013 BCSC 454; 2012 BCSC 626; 2011 BCSC 1078; 2010 BCSC 8; 2009 BCSC 1786; 2009 BCCA 414; 2009 BCSC 860; 2008 BCSC 1691 – Acted for defendant on complex corporate litigation matter at trial and in appeal proceedings.
